There are a few things you should do directly after being arrested for a DUI in California to ensure that you will face the minimum punishment and fines.

1. Contact the DMV

The sole purpose of the DMV DUI hearing is to determine whether or not your driver’s license will be suspended as a result of being charged with a DUI. Unlike the criminal court hearing, the DMV Hearing is much more relaxed and you should generally have an easier time proving your innocence.

Schedule a DMV DUI Administrative Hearing at your local DMV Driver Safety Branch.

2. Obtain and Review the Police Report

The Police Report is available on your first court date. This court date is listed at the bottom of the ticket you were given.

3. Educate Yourself About Your DUI Defense Options

You have 3 choices:

  • represent yourself
  • obtain a public defender
  • or hire an attorney

You may request a 2 to 3 week continuance to decide. Clearly your best chance of beating your case is to hire a criminal defense attorney.

It can be argued that the single most important thing to do after you’ve been arrested for a DUI is to hire a criminal defense attorney. DUI cases can be confusing and intimidating and it pays to have an attorney who knows the best approach for your individual case.

4. Know Your Court Options

Essentially, unless your case can be dismissed by a good DUI attorney, you will either accept a plea deal, or take the case to trial. There are advantages and disadvantages to both, and it’s best to consult a DUI Attorney ​to find the best route for your case.
