What to do Right After a DUI Arrest in California

According to the right after a DUI arrest in California, there are a few things you should do directly after being arrested for a DUI in California to ensure that you will face the minimum punishment and fines.

1. Contact the DMV

The sole purpose of the DMV DUI hearing is to determine whether or not your driver’s license will be suspended as a result of being charged with a DUI. Unlike the criminal court hearing, the DMV Hearing is much more relaxed and you should generally have an easier time proving your innocence.

2. Obtain and Review the Police Report

The Police Report is available on your first court date. This court date is listed at the bottom of the ticket you were given.

3. Educate Yourself About Your DUI Defense Options

You have 3 choices:

  • represent yourself
  • obtain a public defender
  • or hire an attorney

You may request a 2 to 3 week continuance to decide. Clearly your best chance of beating your case is to hire a criminal defense attorney.
